Casual mod users will generally not download illegal content if it is in fact illegal. We had enough problems dealing with the people crying over the OC sniper rifle and gauss gun. This is about 100 times worse, plus Valve have stated that if the code is used and distributed, there will be hell to pay.
My guess is if they do end up releasing a non-licensed version of the source engine hl2 or tf2, it will be via torrent. But I still think their project is hella ambitious, just like MI and BMS. So the chances of a release are slim to none.
